General Provisions

This agreement is between videonova.ua (hereinafter referred to as the site administration) - the company providing access and services to the videonova.ua site (hereinafter referred to as the site), and an individual - visiting the site pages or using at least one of the services provided within the site (hereinafter referred to as the site visitor). The User Agreement regulates the procedure of use of resources, services, opportunities of the site, provided by the administration of the site for receiving, placement of information and communication.

1. Website visitor

1.1 A visitor is any individual who has visited the site and viewed at least one page without prior registration or authorization on the site or forum.

1.2. A visitor who registers and logs in using his or her unique identity becomes a user of the site.

1.3. The user has access to the advanced features provided within the site.

1.4 In order to use the resources, services, and features of the site, users must first express their acceptance of the Agreement. Users may not use the site unless they accept the terms of the Agreement.

1.5 The Visitor has no right to use the services of the site and cannot accept the terms of the Agreement if he/she has not reached the legal age for entering into such agreements; or has not fulfilled other conditions for entering into such agreements stipulated by law.

2. Use of site materials

2.1. Only registered visitors, site users, can use the site's interactive resources, leave feedback, comment on materials, publish their own materials and communicate online.

2.2. The user has the right:

2.2.1. posting;

2.2.2. comment on entries;

2.2.3. Use the resources of the site in other ways that are not inconsistent with the basics of its activities.

2.3. Unless otherwise noted, the site administration owns the copyrights to the materials, resources, and services on the site.

2.4 Copying materials from the site without the written consent of the administration is prohibited.

2.5 Partial citations of material on the site are allowed on an occasional basis with mandatory reference to the source page of the quote (not more than 5% of the total material).

2.6. All names, titles, trademarks, symbols and slogans duly registered are the property of their legal owners. The ® and/or ™ symbols are not used in the materials on this site.

3. Rules for commenting and writing feedback

3.1. When writing reviews and comments, the user must adhere to the rules and restrictions.

3.2. Ignorance of the rules, including restrictions on posting information and use of site resources, does not exempt the site visitor (including the user) from following them, and in case of their violation — from liability under the terms of this Agreement and Ukrainian legislation.

3.3. The site prohibits:

3.3.1. Using comments inappropriately (for example, for buy/sell ads or to ask other users questions);

3.3.2. offensive behavior toward other visitors, as well as members of the site administration;

3.3.3. posting foul language;

3.3.4. posting messages to provoke annoyed reactions from other members (trolling);

3.3.5. Placement of unauthorized advertisements, commercial messages or announcements;

3.3.6. posting materials containing abusive language, signs of discrimination based on national, ethnic, racial or religious affiliation;

3.3.7. Unauthorized posting by the user of materials whose copyrights belong to third parties;

3.3.8. Propaganda of computer and audio/video piracy in any form, publication of links to files and/or sites directly infringing or contributing to the violation of copyrights of third parties (torrent-trackers, file sharing, warez-sites);

3.3.9. Creating accounts where the username mimics the service names (Administrator, Moderator, etc.) or is similar to the name of an already registered user;

3.3.10. Use of capital letters, punctuation and special characters in the text of messages, except in cases that are regulated by the rules of the language used;

3.3.11. Publication of calls to violent change or overthrow of the constitutional system, seizure of state power; to change the state border of Ukraine; to pogroms, destruction of property, taking of buildings or constructions; to aggression or unleashing of military conflict; other actions and publication of any messages prohibited by Ukrainian legislation;

3.3.12. Posting messages (reviews, comments) that repeat in whole or in part or in content and meaning the previous messages (reviews, comments), including those removed by the site administration on the basis of this Agreement.

3.4 Posts that are devoid of information or that do not relate to the topic of the resource are not welcome on the site.

4. Responsibility for posting

4.1 The site provides users with a forum for communication (reviews, blogs, forums, commenting system, etc.). Any user can have an opinion on the site.

4.2 The responsibility for the accuracy of the information posted in the public sections of the site (reviews, forum, comments) is solely the responsibility of its author.

4.3. The public sections of the site are subject to post-moderation - review by a moderator (an authorized representative of the Administration) after the posting.

4.4 Visitors who believe that information on the site directly violates someone's interests and the user who posted the information may contact the Site Administration to resolve disagreements caused by the information posted on the site. Such visitors and / or users are required to independently, by means of communication within the site to try to resolve disputes in their opinion, taking reasonable measures to do so.

4.5. Site Administration has the right to terminate the Agreement with the user at any time, including if the user has violated any provision of the Agreement or committed acts that clearly indicate that the user does not intend or cannot comply with the provisions of the Agreement.

4.6 The moderator, if the user violates the terms of this provision, may remove the posted information, feedback, comment; block the account; deny the user access to the site or exclude access to some features of the site by IP-address.

4.7 Clearly reasoned challenges to the actions of moderators can be made by communicating with the site Administration.

5. Confidentiality Agreement

5.1. The procedure for the collection, use and disclosure of information that may be treated as confidential is governed by a Confidentiality Agreement.

5.2 By accepting the terms of this Agreement or by visiting the site's pages, the visitor automatically agrees to the terms of the Privacy Agreement in regard to the use of personally identifiable and non-personally identifiable confidential information, respectively.

5.3 Collection, storage, use, processing and disclosure of information obtained by the site administration as a result of visiting by the private person (visitor or user) its sites and/or completing registration forms, including personal user data is carried out by the site administration in accordance with the laws of Ukraine. The private person (visitor or user) understands and gives his consent to the collection and processing of his personal data by the site administration within the framework and for the purpose provided by the terms of the User Agreement, Confidentiality Agreement in accordance with the laws of Ukraine; undertakes to notify the administration of the site in writing about the changes in his personal data.

6. Processing and storage of your personal data

6.1 We guarantee the confidentiality of personal data and apply organizational and technical measures to protect personal data. In certain cases, the site administration interacts with its partners in processing personal data and communicates this data to them. In such cases we ensure that appropriate data protection measures are in place. This means we do not share any data with partners whose practices we find questionable, or if we know those practices differ substantially from the practices described in this agreement.

6.2. We can store two types of personal information:

6.2.1. Identification information, including first name, last name, and IP address;

6.2.2. Contact information, including the user's email.

6.3. We process personal data for several reasons:

6.3.1. To allow site visitors to leave comments using our site (if they wish).

6.3.2. To make the services work (for example, to show actual ads).

6.3.3. To allow site visitors to receive our newsletter when they subscribe.

6.3.4. So that we can collect statistics. We need statistics for two reasons: to see if our services are available to our visitors, and to understand how visitors use our services, so we can make services more convenient for visitors based on what they observe.

6.3.5 We use the data we receive from you (first and last name, email address for newsletters) only when we have received your consent to process such data.

6.4. Retention times for different data may vary

6.4.1. Personal data allowing us to analyze the availability of services is stored for three years.

6.4.2 The personal data that enables you to comment is kept until you stop using the commenting feature. If you wish to delete this data, please send us an email and we will delete your profile.

6.4.3 The personal information we hold is not used to personalize anything elsewhere (in legal terms, this means that we do not create any automated solutions or profiles based on this data).

6.5. You are entitled to:

6.5.1. The ability to change your personal information if it is not complete and/or incorrect.

6.5.2. Request to delete your personal data.

6.5.3. If you believe your rights and interests have been violated, you may file a claim. We will do our best to remedy the situation. Please send us an email for this purpose: info@videonova.ua.

7. Cookies

7.1 In order to make your visit to the site more convenient, track your site visits and improve our service, we collect a small amount of information sent from your browser, called cookies. If you prefer, you can disable the sending of cookies (please refer to your Browser settings to learn how to do this). However, please note that disabling cookies may limit your ability to use the Site.

8. Concluding Provisions

8.1. By completing the registration form on the site, the visitor automatically accepts the terms of this Agreement.

8.2 The visitor accepts the terms of the Agreement in case of actual use of the site. In this case, the user understands and agrees that the site administration will consider the fact of the user's use of the site as consent to the terms of the Agreement from the appropriate point in time.

8.3. The activity of the site's administration is carried out in accordance with the legislation of Ukraine. Any claims, disputes and official appeals will be considered only in the order provided by the legislation of Ukraine.

8.4 The Site Administration shall not be liable for any direct or indirect damages suffered by Visitors, Users or third parties, or lost profits resulting from videonova.ua.

8.5 User agrees that User is solely responsible (and that Site Administration has no responsibility to User or any third party) for any breach of User's obligations under this Agreement and for all consequences of such breaches (including any loss or damage that Site Administration may suffer).

8.6. The terms of this Agreement may be changed unilaterally by the site administration. The text of the current Agreement is available here.
